Texify.it Terms & Conditions

1. Acceptance

By creating an account or using texify.It (“the Service”), including logging in through Google or GitHub, you agree to these Terms, our Privacy Policy, and our Copyright & DMCA Policy. If you do not agree, you must not use the Service.

2. Service Overview

texify.It provides tools to extract, transcribe, translate, analyze, edit, and export content derived from:

• Images and PDFs
• Documents and scans
• Logos and brand assets
• Audio and video files
• Content retrieved from supported URLs (YouTube, Facebook, Instagram, TikTok)

Features vary by plan. Free users may have limited access. Processing of audio/video/URL content is available only on Pro and Business plans.

3. Account Registration

You agree to:

• Provide accurate information.
• Maintain the confidentiality of your credentials.
• Accept full responsibility for activity under your account.
• Authorize texify.It to access basic authentication data when signing in through Google or GitHub.

4. Plans, Credits & Billing

• All prices are in USD. Subscriptions auto-renew unless cancelled.
• Credits refresh at the start of each billing cycle. Credits do not roll over unless explicitly stated.Credits refresh at the start of each billing cycle. Credits do not roll over unless explicitly stated.
• Document credits are consumed per page. Audio, video, and URL extraction credits are consumed per minute (rounded up).
• Payments are processed via Stripe. texify.It does not store card details.
• No refunds are issued unless required by law.

5. Acceptable Use

You agree NOT to:

• Upload or process illegal, copyrighted, trademarked, or proprietary content without explicit permission from the rights holder.
• Upload logos or brand assets you do not own or control.
• Upload recordings of individuals without lawful consent and compliance with local privacy and recording laws.
• Submit URLs or content from platforms (YouTube, Instagram, TikTok, Facebook) unless you have the legal right to do so.
• Use the Service to violate any platform’s Terms of Service.
• Train AI/ML models using texify.It outputs.
• Circumvent rate limits or abuse API endpoints.
• Interfere with or reverse-engineer the platform.

6. Intellectual Property

• You retain ownership of content you upload or submit.
• You grant texify.It a temporary license to process your content solely for providing the Service.
• texify.It owns its platform, software, AI models, branding, features, and documentation.
• User feedback may be used by texify.It without compensation.

7. User IP Warranty (Logos, Trademarks & Media Rights)

You represent and warrant that:

• You own or have obtained all rights needed to upload and process any content.
• You will not upload copyrighted or trademarked material—including logos, designs, brand assets, or protected media—without authorization.
• You understand that texify.It does not verify ownership of uploaded content and disclaims all liability for your uploads.

8. Audio/Video & Personal Data Consent

By uploading audio or video files, you confirm:

• You have obtained lawful consent from all individuals whose voices or likeness appear.
• You comply with global privacy laws (GDPR, CCPA, PIPEDA, etc.).
• You assume full responsibility for recordings involving minors or sensitive data.

texify.It is not liable for unauthorized or unlawful recordings.

9. URL & Platform Compliance

You agree that:

• URL-based extraction is allowed only for content you legally own or are authorized to process.
• You will comply with all applicable platform rules, including YouTube, TikTok, Instagram, Facebook, and others.
• texify.It does not download or provide access to content in ways prohibited by these platforms.
• You indemnify texify.It for violations of third-party platform rules.

10. DMCA Safe Harbor Notice

texify.It complies with the Digital Millennium Copyright Act (DMCA) and similar global copyright frameworks.

To submit a copyright complaint, send a takedown request to:

• Identification of copyrighted work
• Identification of infringing material
• Your contact information
• A statement of good-faith belief
• A statement under penalty of perjury

texify.It reserves the right to remove content or suspend repeat infringers.

11. Data Handling & File Deletion

• Files are automatically deleted from temporary storage after processing.
• texify.It does not retain original files beyond the processing period.
• Processed results may be retained in your account for your use.

12. Disclaimers

texify.It is provided "AS IS" and "AS AVAILABLE"

No guarantees are made regarding:

• Accuracy of OCR, translation, audio/video transcription, or financial analysis.
• Error-free or uninterrupted service.
• Suitability for legal, financial, or professional use.

13. Limitation of Liability

To the maximum extent permitted by law:

• texify.It’s liability is limited to the greater of USD $100 or the amount paid in the last 12 months.
• texify.It is not liable for indirect, incidental, punitive, or consequential damages.
• texify.It is not liable for copyright, trademark, consent, or platform violations arising from user content.

14. Indemnification

You agree to indemnify, defend, and hold texify.It harmless from all claims arising from:

• Copyright or trademark infringement relating to uploaded or URL-based content.
• Privacy, consent, or recording law violations.
• Misuse of the Service or breach of these Terms.
• Violations of third-party platform policies.

15. Account Termination

texify.It may suspend or terminate accounts for:

• Breach of Terms
• Abuse or fraud
• Repeated copyright violations
• Security or legal risks

Users may cancel anytime. Data may be deleted immediately upon termination.

16. Governing Law

These Terms are governed by the laws of Ontario, Canada.

Exclusive jurisdiction: Toronto, Ontario.
